Welcome to Hi eSIM! Please read these Terms of Service (“Terms”) carefully before using our mobile apps or www.hi-esim.com (the “Website”). These Terms govern your use of:
- our eSIM-based mobile data plans (“Data Plans”),
- our mobile apps and website,
- related value-added services (“Services”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Introduction
Hi eSIM, operated by [Your Company Name and Legal Address], provides eSIM Data Plans and related services for personal and travel use.
These Terms are intended for individual consumers. If you are using Hi eSIM on behalf of a business, please contact us to request applicable terms.
We may update these Terms periodically to comply with law, improve services, or ensure security. Updated Terms will be published on www.hi-esim.com. Continued use of the Services after changes are posted signifies your acceptance.
2. Eligibility
You must be at least 18 years old and legally authorized to enter into these Terms.
Restricted Countries
We do not provide products or services to, from, or within the following countries or regions, in accordance with international sanctions and the policies of our payment processors
Iran
Cuba
North Korea
Syria
Crimea, Donetsk, and Luhansk regions of Ukraine
Any attempt to access or use our services from these jurisdictions is strictly prohibited and may result in immediate suspension of access without notice.
3. Services
We provide:
- eSIM Data Plans that allow you to connect to mobile networks worldwide.
- Optional Security Features (if activated): VPN-like Virtual Location, Ad Blocker, and Web Protection.
You must have an unlocked and eSIM-compatible device. A sample list of compatible devices is provided on our Website.
Once you purchase a Data Plan, you must download and install the eSIM on your device. The eSIM remains on your device until you delete it or the Data Plan expires.
Data Plans are valid for the duration and data volume purchased. Unused data expires at the end of this period and is non-refundable.
4. Account Registration
You can register via our Website or mobile apps. You are responsible for:
- providing accurate information,
- maintaining the security of your account,
- notifying us of any unauthorized use.
You must not share your account with others.
5. Purchases and Activation
Purchases are made via our Website or apps. Charges are displayed before confirming your purchase.
To activate your Data Plan:
- Purchase the desired plan.
- Download the eSIM to your device.
- Activate the Data Plan.
Stable internet is required for eSIM download and activation.
Auto Top-Up (if enabled): automatically renews Data Plans when depleted. You may disable this feature at any time.
Security Features may be enabled by default and can be turned off in the app.
6. Refund Policy
Refunds for Non-Activated Data Plans:
- Full refund available if the eSIM has not been installed or the Data Plan has not been activated.
Refunds for Activated Data Plans:
- If more than 99% of data remains unused or there is a proven service issue caused by Hi eSIM, we may grant a full or partial refund at our discretion.
Restrictions:
- No refunds for deleted accounts.
- No refunds for charges incurred from alternate devices or providers.
- Refund requests must be made within 30 days of purchase.
Refunds will be processed within 30 calendar days of approval.
7. Use of Services
By using Hi eSIM Services, you agree to:
- use Services for personal and lawful purposes only,
- not use Services for illegal, fraudulent, or abusive purposes,
- not resell or share Data Plans commercially.
Unlimited Plans (if offered): subject to Fair Usage Policy. E.g., daily 5 GB full-speed cap, after which speed may be reduced.
8. Provision of Services
Services are provided on an “as is” and “as available” basis.
We do not guarantee:
- uninterrupted connectivity,
- full network coverage in all areas,
- fault-free operation.
We may select network partners at our discretion.
9. Charges and Payments
All purchases are prepaid and include applicable taxes.
You authorize us to charge your selected payment method. You agree to ensure sufficient funds and accurate payment information.
10. Suspension of Services
We may suspend or terminate your access if:
- you violate these Terms,
- we suspect fraud or misuse,
- we are required to comply with legal orders,
- operational/security reasons require suspension.
11. Lost or Stolen Device
If your device with an active eSIM is lost or stolen, notify us immediately at support@hi-esim.com. We will take reasonable action to suspend the Services.
You remain responsible for usage until we are notified.
12. Disclaimer of Warranties
Services are provided “as is” without warranties of any kind.
We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability
To the maximum extent permitted by law, Hi eSIM shall not be liable for:
- indirect or consequential damages,
- loss of profits,
- service interruptions,
- loss of data.
Our total liability is limited to the amount you paid for the affected Service in the 12 months prior to the claim.
14. Indemnification
You agree to indemnify and hold harmless Hi eSIM and its affiliates from any claims, losses, damages, or liabilities arising out of your use of the Services or violation of these Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of Austria (or another jurisdiction of your choice).
Any disputes will be resolved in the courts of Vienna, Austria, unless otherwise required by mandatory consumer protection laws.
16. Miscellaneous
- These Terms constitute the entire agreement between you and Hi eSIM.
- If any provision is found invalid, the remaining provisions remain in force.
- We may update these Terms at any time.
